All entities, including nonprofit organizations, state and local governments, and others, that receive Federal grants are mandated to register with SAM.gov and acquire a Unique Entity ID (UEI) number.
Before April 2022, the federal government utilized the DUNS number as an entity ID number; however, this has since changed. If your organization does not already possess a SAM.gov UEI, it is crucial to obtain one and notify the ARPA Compliance Officer before any procurement activities begin.
Additionally, private contractors or vendors who receive more than $50,000 in ARPA funds must also secure a SAM.gov UEI.
Subrecipients of Lynn's ARPA SLFRF program are encouraged to contact Tim Leonard, Purchasing Agent for the City of Lynn, and Joseph Hustins, ARPA Compliance Officer, prior to making any purchases for supplies and services.
The following federal procurement regulations must be followed by subrecipients when using ARPA funds:
Federal Procurement Thresholds:
- Purchases under $10,000 are considered micro-purchases. In this case, no quotes or bidding is required.
- $10,000 - $250,000 are considered small business purchases. Within this bracket, multiple written quotes, from 2 or more vendors, are required.
- Purchases over $250,000 require a public bid or RFP (Request for Proposal). At least 2 bidders must submit proposals.
Avoid the appearance of bid-splitting. Bid-splitting is intentionally dividing a purchase into two or more smaller purchases for the purpose of evading the requirements of a procurement law. This practice is illegal. In some instances it makes good business sense to make small, frequent purchases. Please contact Tim Leonard before performing these types of purchases.
Construction Contracts:
- Must include Equal Employment Opportunity Provision (EEO) as written in 41CFR 60-1.4(b).
- Must include a provision for compliance with Copeland Anti-Kickback Act (40 USC 3145).
Contracts Over $100,000:
- Must include certification from bidder complying with Byrd Anti-Lobbying Amendment (31 USC 1352).
Contracts Over $250,000:
- Breach of Contract Clause: Must include legal remedies if the contractor breaches or violates contract terms.
Contracts Over $100,000 That Involve Mechanics or Laborers:
- Must include certification of compliance with USC 3702 Clean Air Act.
- Must include certification of compliance with USC 3704 Federal Water Pollution Control Act.
In their signed MOU, ARPA subrecipients agree to comply with, and adhere to Uniform Grant Administrative Requirements as outlined in 2 CFR Part 200.
Subrecipients of Lynn's ARPA SLFRF program are required to report on the status of their project(s) to the City of Lynn's ARPA Compliance Department.
This report will be used to inform the City of Lynn's federal quarterly report to the U.S. Treasury.

To receive awarded funds, subrecipients of Lynn's ARPA SLFRF program are required to submit invoices to the City of Lynn for reimbursement. All invoices must be accompanied by appropriate back-up documentation including: copies of receipts, statements, packing slips, payroll proofs, timesheets, cancelled checks, etc. It is anticipated that the City of Lynn will be audited by the federal government and back-up documentation for all expenditures must be maintained in City's files for review by the U.S. Treasury and the IRS.
